Le Ly Hayslip: Between East and West

The West has always been generally regarded as a negative force upon Asian cultures in the sense that the introduction of Western ways brings irrevocable changes that stains the purity Oriental cultures. On the other side of the fence, the West has always regarded the East as a land of exotic people, stubbornly clinging to their old ways, refusing to change with the times. Indeed it is a clash between the immovable rock and the irresistible force, and people in the crossroads get caught and get lost in the maelstrom, with a few coming out unscathed. Le Ly Hayslip’s book When Heaven and Earth Changed Places chronicles such a struggle. It is a poignant book that captures the rending of one’s soul, when one is caught between the need to change and the desire to cling to the old and the familiar. The encroachment of the West first took place within the context of the Vietnam War, when the United States allied itself with South Vietnam against the communist North. More than a book about how war changes a life, the book is about how Le Ly Hayslip straddled the East and the West and how she managed to keep herself whole and survived. The book captures the epic life of Le Ly Hayslip, from her childhood, to her life as a young woman escaping to the United States, to her return to her native land, some twenty years after. This paper seeks to take a look at Le Ly’s life at three important milestones and understand how the West has imposed itself upon her world and how it changed her life as well as those of the people she loved. The West first came into Le Ly’s life when she was still very young. Perhaps in an uncanny prediction of her destiny, her village straddles the border between the conflicting South and North Vietnam. Their lives were constantly being pulled by soldiers from each side and their loyalties were constantly shifting and the people were under constant threat of violence and threat to their lives. Le Ly captures the simplicity of their life as well as the suffering they endured at the crossroads, â€Å"Although the land remained fertile, farming was often interrupted and the whole village came close to destruction.† (5) While the influence of the West is not so direct in this case, it can actually be seen in the civil war that is going on in her country. For a long time, Vietnam has been a colony of France, and it was only after World War did Vietnam finally gain its independence. However, the fledgling country soon fell under the shadow of communism through the influence of China, which in turn was being controlled by the Soviet Union. In light of this, it might be said Western imperialism has been affecting Le Ly’s life from the day she was born. The desire of the Soviet Union to spread the communist ideology is the reason why South and North Vietnam are at war. When Le Ly was 14 years old, Le Ly and her friends worked as lookouts for North Vietcongs. The South discovered what she was doing and she is arrested and tortured. When she is released from prison, the Vietcongs regard her with suspicion and sentence her to death, charging her with espionage. However, instead of killing her, the two soldiers tasked with carrying out her sentence raped Le Ly instead. It was at this juncture that Le Ly left her village to work in the town of Saigon. In Da Nang, she took on several jobs, working as a maid, a black-market vendor, and a prostitute. It was at this stage of her life that Le Ly met several Americans. Her bad experiences in the hands of the Vietcongs as well as the relatively good treatment she received from the Americans have changed Le Ly’s values and allegiances. This relatively pleasant encounter with the West has planted in Le Ly the desire to leave Vietnam and start a new life in the United States. She saw the West as a land of promise, where she can escape from all the violence and war in the East. She saw a chance when Ed, asks her hand in marriage, after which, they immediately left Vietnam with her son in tow. When Le Ly left for the United States, she longed to someday return to her home land, but she was also unsure if she will ever have that chance. In the United States, she gets down to settling to a new life, resolved to leave the past behind. Of course that is easier said than done, and her love for her family and the longing to return to Vietnam never left Le Ly. This desire became stronger when Le Ly found prosperity and success in the United State. After so many years of living as an American, Le Ly returned to Vietnam. In all her years living in the United States, she managed to stay true to her eastern roots. The Buddhist ways that Le Ly’s father taught her served as the anchor of her identity, and she never gave up this part of her that she held sacred. Between the East and the West, Le Ly found a haven in the love and respect that she had for the two countries that she calls home. And that perhaps is the reason why Le Ly was able to reconcile the conflict and rage that was tearing her soul apart. She soon comes to an understanding and by her own words Le Ly thus describes the freedom and wisdom in living a life of compassion, Vietnam already had too many people who were ready to die for their beliefs. This case was heard by the High Court of Australia. In this case, the respondent was successful during the trial. Similarly, the responder proved to be successful when the Full Court of Supreme Court of South Australia heard the appeal. Under these circumstances, Modbury Triangle Shopping Center made an appeal to the High Court of Australia. The facts of this case can be briefly described as follows. In this case, the appellant, Modbury owned a shopping center. On the other hand, Mr. Anzil, the respondent was hired by a video store that had leased premises in the center. In front of the weekly shop there was a large outdoor parking for the center. The car park was owned by the shopping center, Modbury. The video store remained open until 10 PM in the night and after that time the lights of the car park were automatically switched off. In this case, the respondent was leaving his workplace at 10:30 PM on a Sunday night and the lights of the car park were turned off. Subsequently, the respondent was attacked by three unidentified persons. One of the assailants had a baseball bat and the respondent suffered serious injuries. According to the lease agreement, the lighting in the common areas like the parking area was provided. According to the discretion of the appellant had a part of the cost was paid by the tenant. It was pointed out by the court that in this case, the claim of the building was not based on the physical conditions in the car parking (for example that he had tripped over due to bad lighting). Instead, the claim in the present case was based on the third party's deliberate criminal actions. Therefore the issue in this case was related with the liability of the defendant for an omission, particularly the liability of the defendant regarding the criminal actions of third party. Moreover, the occupiers in a better position as compared to an entra nt to know regarding the physical condition of the premises.[4] Regarding the issue of a duty of control over third parties, it was the opinion of the majority in this case that the scope of the duties of an occupier does not extend to third parties. Apart from the exceptional circumstances or in case of the presence of the special relationship between the parties, liability is not imposed by the common   law regarding the ommission to take positive steps for the purpose of protecting the other person from the criminal actions of the other party. It was also stated in this case that if a special relationship is not present, it is not the duty of a person to take steps to prevent causing harm to another person as a result of the interactions of a third party even if such a risk can be described as foreseeable. It will also recognize by the court that under some exceptional cases, a duty can be imposed on a party to take positive steps that are required in order to prevent a reasonably foreseeable risk. That has been created independent from the conduct of the defendant. Such a situation arises in cases where there is a special or protective relationship present between the parties, and an obligation has been assumed by the defendant to protect the plaintiff.[5] It can be said that such a protective relationship is present where the defendant has the capability to control the risk of harm that may be caused to the plaintiff and in cases where the plaintiff can be described as vulnerable and depending on the plaintiff for the prevention of such harm.[6] But in the present case, it was noted by the court that the occupier was not in a position to control the actions of the assailants. Similarly, the occupier did not have any knowledge regarding the impending attack. The court stated that the middle attacks cannot be predicted and it was not possible for the occupier to control such an attack.[7] Under these circumstances, it was stated that the occupier cannot be held liable in the present case, because the immediate and direct cause of the injuries suffered by the plaintiff was the attack by the offenders and these injuries were not suffered as an absence of lighting. Similarly, this fact was also noted that responsibility was not assumed by the occupier regarding the safety of the respondent. It was reasonable for the occupier to believe that the employer of the respondent would protect him. Concerning the occupier, the respondent can be placed in similar position in which any other member of the public can be placed. Similarly in the present case, the contribution of the occupier in the injuries suffered by the respondent was negligible. If liability is imposed on the occupier, it would mean that the financial responsibility has been shifted regarding the consequences of a crime, from the wrongdoer to another person. Even if such person did not have the capability to impact the behavior due to which the injuries were caused. Moreover the court stated that there is no doubt that an occupier of land has the duty of care towards the persons who unlawfully present on the land. In the present case also, it can be said that the appellant had a duty towards the first to respond and regarding the physical condition of the car park. However, the issue in this case was related with the fact if the appellant also had a duty of the kind that is relevant for the harm that was offered by the first respondent. This issue was discussed in this case in the form of the argument related with the nature or scope of the duty. In the present case, the nature of farm caused to the respondent was in the form of physical injuries that have been caused by a third party and the respondent did not have any control over the actions of the third-party.[8] Therefore, it can be said in the present case that any relevant duty in such circumstances can be described as the duty related with the security of the respondent. Under these circumstances, the majority decision given by the High Court was that the appeal of Modbry should be allowed on both the issues. Consequently, it was decided by the High Court that Modbury cannot be held liable for injuries suffered by Mr. Anzil. In support of the decision, it was stated by the court. That being an occupier of land, Modbury has a duty of care towards Mr. Anzil but this duty cannot be considered to be extending to take reasonable steps for the purpose of preventing the criminal actions of third parties, as a result of which, physical injuries were suffered by Mr. Anzil. Under the circumstances where Modbury did not have any control over the conduct of the attackers. The court pointed out that even if it can be said that the failure of Modbury to provide proper lighting in the car park could have facilitated the time in the same way as it had made provision for the car park and descent and decided to park his car there but it cannot be treated as the. Main cause behind the injuries suffered by Mr. Anzil. In this case, the direct cause due to which Mr. Anzil had suffered the injuries was the conduct of the three assailants over which Modbury had no control. It was also noted by the court that in this case, the inadequate lighting had not caused the concealment of a dangerous object or condition in the carpark as a result of which, damage may have been suffered by person or property. Due to the unpredictability of criminal behavior, as a general rule, and when a special relationship is not present, a duty is not imposed by the law to prevent harm to another person caused by the criminal conduct of third parties even if such harm can be described as reasonably foreseeable.[9] Therefore the court stated that the occupier, Modbury was not liable for the injuries suffered by the respondent. Tradional Dance Essay The Ibans perform a unique dance called the ngajat. It serves many purposes depending on the occasion. During Gawais, it is used to entertain the people who in the olden days enjoy graceful ngajats as a form of entertainment. The origin of this indigenous dance is not clearly known but it is believed to have been in existence along with the Iban tribe since the 16th Century. The Ngajat dance is believed to have been performed by warriors on their return from battles. . The male dancers wear large feathers as part of their headgear, hold an ornate and long shield in their hand with chains, beads and a loincloth called the ‘cawat’. The female dancers have an elaborate headdress, chains, beads and a ‘dress’ that reaches to below their knees with intricate weaving. Pattberg and Dingwerth (2006:188) accept that, the meaning of global governance stems mainly from the fact that the concept is evoked not only where governance in the sense in which it has been introduced in political theory is at issue, but also in a variety of further contexts. In this regards, it evaluates that the idea of global governance it relevant link with highly political processes, focused on accountability, legitimacy authority, democracy, though which increasing of market liberalisation and poverty reduction programmes can be addressed as global issue. In addition Pattberg and Dingwerth (2006:187) state that, global governance perspective can be defined in two major part namely normative and analytical uses. Normative use, is explained as political programme, global governance is not so much an empirical or analytical term as it is political concept that capture a vision of how societies should address the most pressing global problem. The above definition emphasise that, global governance as political programme does not provide the consideration on the different extending problem it focus on political struggle, social transformation, democracy, power and rule of law. At this point in time global governance is still more vision than description of actual state of the international state (ibid.2006:194). On the other hand, analytical uses (observable phenomenon) level of implementation and pursuit of goals is very crucial for the process of global governance, Global governance is conceived to include system of rule at all levels of human activity from the family to the international organisation. (ibid.2006:189) In generally, this perspective insists that, the level of implementation of global governance is very essential and can be determined from family to international level. Hence, the term global does not directly mean only global in nature, but also the need to emphasize solving problems in state, regional and international levels is very necessary. In generally, Global governance is understood as the way of solving globally problems. Most literatures describe this concept as a process of finding the solution to existing problems globally. Whitman (2009:8) argues that, global governance suffices to outline the scope of global governance as an activity: Efforts to bring more orderly and reliability to social and political issues that are beyond the capacity of states to address individually. The above definition it evaluates that, the notion of global governance is an instrument or tools which is based on facing of emerging global problems, hence individual states may not alone solve the existing or emerging humanitarian and political problems.
